Termini di utilizzo del sito

This document governs the general terms of use of the website "Notes from the Past, Sounds of the Future – New compositions inspired by the Neapolitan school of the 18th century" (hereinafter, the "Site"), accessible at www.domenicoscarlatti.it and managed by the Domenico Scarlatti Association (hereinafter, the "Owner"). By accessing, browsing, or using the Site and its related services (for example: viewing pages, enjoying multimedia content, using contact or competition registration forms), the user fully accepts these Terms of Use. If you do not accept them, you are required to immediately stop browsing. The Terms of Use should be read in conjunction with the Privacy Policy and the Cookie Policy, which describe the methods of processing personal data and the use of cookies by the Site.

The user agrees to use the Site and any services that may be made available (such as contact forms, newsletter sign-ups, and Contest Registration forms) in full compliance with the law, these Terms of Use, and the rights of third parties.

In particular, the user is prohibited from:

sending illegal, defamatory, discriminatory, obscene content, or content that is otherwise contrary to public order and good morals;
using the Site's systems for fraudulent purposes, for unauthorized access attempts to data, systems, or networks, or to compromise the operation of the Site itself;
uploading or transmitting materials that may contain viruses, malware, or other harmful codes;
using data, materials, or information obtained through the Site for unauthorized commercial purposes or in conflict with the cultural and institutional purpose of the project;
improperly using contact channels (e.g., through the form on Contacts) to send unsolicited advertising communications or bulk messages.
The Owner reserves the right to limit or block access to the Site for those users who engage in behaviors contrary to these rules or that may jeopardize the security, integrity, or reputation of the project and its partners.

All content present on the Site – including but not limited to: texts, photographs, graphics, logos, trademarks, audio and video recordings, podcasts, scores, educational materials, programs, as well as the structure and layout of the pages – is protected by copyright and intellectual property laws. Unless otherwise indicated, the rights to the content belong to the Owner, its partners, or the rights holders indicated from time to time (e.g., authors, performers, music publishers). The user is authorized to consult the Site and use the content solely for personal, study, or research purposes, without profit and in compliance with the relevant licenses. Any form of reproduction, public communication, publication, availability, modification, translation, adaptation, or distribution of the content is prohibited without prior written authorization from the Owner or the rights holders, except in cases expressly permitted by law or specifically indicated on the Site. Any third-party trademarks and logos present on the Site are used solely for descriptive purposes and belong to their respective owners; their use by the user is prohibited without the express consent of the respective owners.

The Owner commits to keeping the Site updated, accessible, and technically reliable, but cannot guarantee the absolute absence of errors, service interruptions, technical malfunctions, or the complete accuracy and completeness of the published content.

To the extent permitted by law, the Owner shall not be held responsible for:

any direct or indirect damages, whether property or non-property, arising from the use or inability to use the Site or its contents;
any errors, inaccuracies, or omissions present in the published information, without prejudice to the possibility of corrections and updates;
any malfunctions, delays, interruptions, or suspensions of service due to force majeure or factors beyond their reasonable control (e.g., network failures, provider issues, cyberattacks);
content, information, or services offered by third-party sites that may be accessible via links on the Site.
External links are provided solely to facilitate navigation and do not imply any approval or control over the related content. Users are encouraged to always verify the terms of use and privacy policies of external sites visited.

Some materials (such as educational content, audio or video excerpts, in-depth texts) may be made available, at the discretion of the Owner, with specific usage conditions (such as open licenses or permissions for educational use). In such cases, the particular conditions will be clearly indicated next to the content or in the relevant section of the Site.

In the absence of different indications, the following general rules apply:
- Sharing via links to public pages of the Site (for example, to sections such as Multimedia Materials or Video & Podcast) is allowed, without altering the content in any way;
- Downloading, extracting, modifying, systematically reusing, or aggregating the contents of the Site to create archives, databases, or competing services is not allowed;
- Any use in editorial, promotional, or commercial contexts requires specific written authorization from the Owner or the rights holders.

These Terms of Use are governed by Italian law, without prejudice to any mandatory provisions for the protection of consumers or users residing in other States.

For any disputes regarding the interpretation, application, or execution of these Terms of Use or, in general, the use of the Site, the exclusive jurisdiction shall be the Court of Naples, without prejudice to cases where territorial jurisdiction is mandatory by law.

The consumer user's right to appeal to the judge of their place of residence or domicile, as well as to resort to alternative dispute resolution (ADR/ODR) mechanisms provided for by current legislation, remains unaffected, where applicable.

The Owner reserves the right to modify or update these Terms of Use at any time in order to adapt them to regulatory developments, changes in the services offered, or organizational and design needs. The changes will be published on this page, indicating, when appropriate, the date of the last update. Users are encouraged to periodically review the Terms of Use, as well as the Privacy Policy and Cookie Policy, to check for any updates. Continued use of the Site following the publication of changes constitutes acceptance of the new conditions. In case of doubts or requests for clarification, it is possible to contact the Owner through the Legal Notes and Privacy section of the Contact page or consult the Competition Regulations for specific conditions related to participation.
